Terms & Conditions

  1. dp Gold Jewellery is engaged in the business of Bullion Trading under the name “dp Gold Jewellery” (hereinafter referred as “dp Gold Jewellery”) and will be selling silver to its customers through “www.dpgoldjewellery.com”(“website”) or the [dp Gold Jewellery] (“Mobile application”) or any similar platform (“hereinafter collectively called the platform”).The platform is owned and operated by Big Bullion Bazaar.
  2. Please read the terms and conditions before registering on, accessing or using the platform carefully. By clicking “I accept”, the same shall be deemed to have been signed, verified and understood by you. The terms and conditions of such purchase are as more fully set out hereunder;

    3. IT IS HEREBY AGREED BETWEEN dp Gold Jewellery AND THE USER AS FOLLOWS:

The following terms and conditions are the terms of a click wrap contract between dp Gold Jewellery and the user (referred to as “you”, “your” etc.), wherein the terms and conditions are accepted by you upon clicking the check box next to the words “I agree to the terms and conditions”. Big Bullion Bazaar provides features to you, only subject to the acceptance of the following Terms and Conditions of Use of the platform. You are deemed to have accepted the Terms and Conditions of Use on continuance of use of the platform. If you do not agree to be bound by these Terms and Conditions of Use you should leave the platform immediately.
  4. dp Gold Jewellery may revise these Terms and Conditions of Use from time to time and at any time, without notice to you.
    The section titles in these Terms and Conditions of Use are for convenience only and have no legal effect.

    5. ACCEPTANCE OF DISCLAIMERS AND EXCLUSIONS

  5. You acknowledge that this Terms and Conditions of Use represent a fair and reasonable allocation of the risks and benefits between you and Big Bullion Bazaar. You agree that these disclaimers and limitations shall be enforceable to the fullest extent permitted by applicable law.

    6. INTELLECTUAL PROPERTY

  6. Any use of this Website/ application or its contents, including copying or storing it or them in whole or part, other than for your own personal, noncommercial use is prohibited without the explicit permission. All information displayed, transmitted or carried on the Website/application is protected by copyright and other intellectual property laws. Copyrights and other intellectual property in respect of the some of the content on the Website/application may be owned by the third parties. This site is designed, updated and maintained by dp Gold Jewellery or its licensors. You shall not modify, publish, transmit, transfer, sell, reproduce, create derivative work from, distribute, repost, perform, display or in any way commercially exploit any of the content available on the Website/ application.

    7. LICENSE AND SITE ACCESS

  7. dp Gold Jewellery grants you a limited license to access and make use of this site for the specific purpose mentioned in this Terms and Conditions of Use. Any unauthorized use other outside the scope of Terms and Conditions of Use terminates the license granted by dp Gold Jewellery. dp Gold Jewellery reserves the right to deal with any unauthorized use of its platform in a manner it deems fit.

    8. ELECTRONIC COMMUNICATIONS

  8. dp Gold Jewellery may communicate with you by letters, e-mail, SMS or by posting notices on the platform. You agree that all agreements, notices, disclosures and other communications that dp Gold Jewelleryprovides electronically satisfy all legal requirements that such communications be in writing.

    9. INDEMNIFICATION

  9. You agree to defend, indemnify and hold harmless dp Gold Jewellery, its employees, directors, officers, agents and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney's fees, caused by or arising out of claims based upon your actions or inactions, which may result in any loss or liability to dp Gold Jewellery or any third party including but not limited to breach of any warranties, representations or undertakings or in relation to the non-fulfillment of any of your obligations under this Agreement or arising out of your violation of any applicable laws, regulations including but not limited to intellectual property rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights. This clause shall survive the expiry or termination of this User Agreement.

    10. INDEPENDENT INVESTIGATION

  10. You acknowledge to have read these Terms and Conditions of Use and agree to them in entirety. You shall independently evaluate the desirability of associating with dp Gold Jewellery or participating in its programs or availing the services and/or products of dp Gold Jewellery, and are not relying on any representation or statements other than as set forth in this Terms and Conditions of Access and Use.

    11. LIMITATION OF LIABILITY

  11. In no event dp Gold Jewellery or any of its officers, directors, shareholders and employees are liable for anything arising out of or in any way connected with your use of the platform. You expressly agree that use of the platform is at your sole risk. dp Gold Jewellery will take all reasonable precautions to ensure uninterrupted and error-free operations, access. Use of the platform is at your sole risk.
  12. dp Gold Jewellery disclaims all warranties of any kind, whether express or implied. In no event dp Gold Jewellery shall be liable for any direct, indirect, incidental, special, punitive, consequential damages, or any damages whatsoever.
  13. dp Gold Jewellery shall not be responsible for any errors, negligence, or inability to execute orders.
  14. The Website/application provides content from other Internet websites or resources and while we try to ensure that material included on the Website/ application is correct, reputable and of high quality, Big Bullion Bazaar shall not be held liable or responsible if this is not the case. Big Bullion Bazaar will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the Website. The platform can contain technical inaccuracies or typographical errors or omissions. Big Bullion Bazaar is not responsible for any losses that you might suffer from such typographical, technical, or pricing errors listed on the website.
  15. dp Gold Jewellery, its associates and technology partners make no representations or warranties about the accuracy, reliability, completeness and/or timeliness of any content, information, software, text, graphics, links or communications provided on or through the use of the Website or that the operation of the Website will be error free and/or uninterrupted. We assume no liability whatsoever for any monetary or other damage suffered by you on account of the delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the Website; and/or any interruption or errors in the operation of the Website.

    16. FINANCIAL TRANSACTIONS AND TAXES:

  16. If you wish to make any financial transactions on the platform, including paying for products or services, you may be asked for payment information. You agree that all information you provide is accurate, complete and current and that you will pay all charges owed, including any applicable taxes.
  17. dp Gold Jewellery has tie ups with various payment gateways for facilitating transactions with you. In the event, there is a failure in such transaction from its payment gateway partner, dp Gold Jewellery shall not be liable to refund the amount.
  18. You agree that you are responsible for any personal income reporting and tax payments to the government authorities except stated otherwise expressly by dp Gold Jewellery either in this Terms and Conditions of Use or in any other document.

    19. ELIGIBILITY

  19. You may use the platform only if you are eligible to enter into contracts under the Indian Contracts Act, 1872.

    20. REGISTRATION OBLIGATIONS

  20. A one-time registration process has been put in place in order to ensure anyone wanting to engage with dp Gold Jewellery to have a delightful experience.
  21. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer and mobile to prevent unauthorized access to your account. You agree to accept responsibility for all activities that occur under your account or password in case of any confidential data leak. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorized manner.

    22. DISAPPROVAL OF APPLICATION

  22. If you provide any information that is untrue, inaccurate, not current or incomplete, dp Gold Jewellery has the right to suspend or terminate your account and refuse any and all current or future use of the platform (or any portion thereof) without any liability.

    23. ACCOUNT SECURITY

  23. Upon completing the registration process with the platform, the system will create unique ID for you. You are responsible for maintaining the confidentiality of account, and are fully responsible for all activities that occur under your account. You agree to (a) immediately notify Big Bullion Bazaar of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session.

    24. ENGAGEMENT ON dp Gold Jewellery

  24. The prices of the products offered by dp Gold Jewellery can follow either the spot-price mechanism or any other price mechanisms as maybe adopted. dp Gold Jewellery reserves the right to reject orders from those who have not paid for previous orders within the time frame stipulated by this Terms and Conditions of Use. dp Gold Jewellery furthermore reserves the right to cancel or refuse any order for whatever reason including but not limited to events where:
    1. The payment has not been initiated or has not reached Big Bullion Bazaar within the time frames given by these Terms and Conditions.
    2. Extraordinary situations arise in the precious metals market causing unforeseeable volatility in price.
    3. Price, stock, delivery time or availability has been published erroneously due to computer-related problems, due to human errors either intentional or unintentional or any act of God.
    4. The price or other information has been published erroneously.
    5. The order is deemed questionable, suspicious, abusive or of significant risk to dp Gold Jewellery.
    6. The use of the platform for any purpose other than that approved and specified by the platform.

    25. PRODUCT & PRICES

  25. All products offered on the dp Gold Jewellery’s platform are an invitation to offer. Your order for purchase constitutes your offer which shall be subject to the terms and conditions. We reserve the right to accept or reject your offer in part or in full. Our acceptance of your order will take place upon the dispatch of the product(s) ordered. Dispatch of product(s) ordered, may or may not happen at the same time. In such a scenario, part of the order which has been dispatched will be deemed to have been accepted by us and the balance would continue to be an offer to us and we reserve the right to either accept or reject the balance offer.
  26. The photos given are a representation for the articles but do not represent the actual size & color. Please use your own discretion for both the photos & the description provided to form your opinion.
  27. Please note that the products sold by dp Gold Jewellery are subject to small differences as compared to the information displayed on the website However, dp Gold Jewellery shall ensure that all products offered by it are of a quality as close to each other as is possible but is not subject to any liability in case of miniscule differences.
  28. dp Gold Jewellery sells bullion products only in bullion condition as permitted under law. dp Gold Jewellery sells products in proof condition assuring the consignment being damage/defect free. Any miniscule damage or minor defects does not entitle the customer for a change or replacement of items unless any markedly visible defect is pointed out at the time of the collecting the item.
  29. Product(s) is sealed and packed by dp Gold Jewellery brand with purity certification. dp Gold Jewellery also takes utmost care of further packaging the seal packed coin and makes sure that it reaches safely.
  30. In case of any issue with regards to quality, you can raise the issue at info@dpgoldjewellery.com. Our team will facilitate in checking the quality of the product as per the standard promised with an independent quality testing center and action would be taken basis the result from quality testing center. You can ensure that the product is immediately made available to the authorized representative for carrying out such testing. Failure to handover samples, shall cause all claims to be automatically rejected. If the quality is not as per the acceptable standards, full refund will be initiated to the purchaser. However, if the quality is as per the standard promised, the concerned person shall be liable for the testing charges. In the event you any tampering or interference with the product and/or markings therein, any consequent claim shall stand automatically rejected.
  31. Live precious metals prices are provided by reputed market data providers in real-time and therefore constantly subject to some variation. All prices on the website are updated constantly, and are therefore subject to change. The price that you are obligated to pay for your order is the price that appears on your order confirmation after the order is placed. This confirmation constitutes a contract, and you are obligated to complete the purchase once the order has been placed. In the event that there is an error in pricing, due to incorrect pricing or malfunction of the price feed, dp Gold Jewellery reserves the right to offer the buyer a requote or a cancellation.

    32. PAYMENTS

  32. Payment for transactions with dp Gold Jewellery shall be made in Indian Rupee alone. The usage of any international credit/debit/e-wallets shall be done in Indian Rupee only, and subject to the terms of this Agreement and the terms of payment service gateway as nominated by Big Bullion Bazaar.
  33. The payment may be made by means of Bank Transfer to Big Bullion Bazaar’s bank account or through payment gateways and must be made within the timeframe of 24hrs.
  34. No cash payment shall be accepted by dp Gold Jewellery.
  35. dp Gold Jewellery reserves the right to hold any or all payment(s) made to dp Gold Jewellery by any means, and to withhold shipment of the related order(s), until you provide the complete information and/or original documentation as legally required.
  36. Except where noted otherwise, the prices displayed for products on the platform represents the value of the respective product. For certain transactions, you shall bear fees and charges in addition to payment for prices displayed on the platform. Such additional fees and charges shall be as are stated on the platform.
  37. With respect to services provided or products sold by dp Gold Jewellery, we cannot confirm the cost of a service or the price of a product until you order. Despite our best efforts, a small number of the items in our catalogue may be mispriced. If an item's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.

    38. STORAGE

  38. By opting for the vaulting service at dp Gold Jewellery, you agree for the storage arrangement where dp Gold Jewellery will store your product under dp Gold Jewellery’s storage agreement with third party secured vaulting service providers.
  39. You are provided with a Silver Certificate (Receipt of Vaulting) for the products entrusted with dp Gold Jewellery’s storage agreement. The products mentioned in the Silver Certificate are under the custody of Big Bullion Bazaar and the ownership rights shall lie completely with you.
  40. You further agree to bear the vaulting charges accrued till physical delivery of the product is completed. You also agree to settle the charges with Big Bullion Bazaar before taking physical delivery of the product.
  41. dp Gold Jewellery assures that the products stored with vaulting agents are safe, secured and insured. The products mentioned in the Silver Certificate (Receipt of Vaulting) are under the custodian of Big Bullion Bazaar in terms of the Custodianship Agreement and the ownership rights lie with you. You can follow the prescribed guidelines if you want to inspect the product and/or physically take delivery of the product.
  42. In the event there is any default in paying vaulting charges for over 30 days, dp Gold Jewellery is authorized to sell any product in custody at the prevailing market price, and reimburse the same to you after deducting all receivables. No explicit notice or authorization shall be required for such action.
  43. It is hereby clarified that the Customer’s Silver cannot be pledged or transferred by You to any other user, unless specifically allowed by Big Bullion Bazaar. In the event of Your death, if specifically allowed by Big Bullion Bazaar, the title to such Customer’s Silver lying in the vault shall be transferred to your legal heirs only after the required due diligence has been conducted. Subsequent to this, your legal heir(s) shall be regarded as the Customer of your Silver thereafter and the Terms shall be applicable to your legal heir(s).

    44. SERVICES OFFERED:

  44. Silver Certificate:
    1. A Silver Certificate shall be issued to you through email. You may take a print out of the same for your records.
    2. You shall pay the vaulting and insurance charges in 15 days advance.
    3. You can either opt for “pick up from vault” or “doorstep delivery” by sending a request from the registered email ID. These facilities can be opted at any time.
    4. Before choosing “pick up from vault” or “doorstep delivery”, you will have to clear the vaulting and insurance dues.
    5. For “doorstep delivery”, logistic cost will be charged.
  45. Pick up from the Vault:
    1. You can pick up the product from the vault directly and vaulting window service charges that are collected at the Vault, needs to be cleared before collecting the products.
    2. Delivery shall be given only if proper ID proof and invoices are presented at the vault. Further, ID Proof of the person collecting the goods needs to be email to by dp Gold Jewellery. dp Gold Jewellery’s customer care team will inform you the details of the pickup.
  46. Door step delivery (delivery to self or someone else):
    1. Delivery will be done to shipping address which is provided to us.
    2. Normal delivery charges of logistic & insurance have to be paid by you. In case if any person other than the direct beneficiary is taking the delivery of the product, the ID proof of the person who will be accepting the product needs to be emailed to us as a security measure.
    3. ID Proof of the person receiving the goods needs to be presented and verified at the time of delivery. The product shall be handed over only after the completion of verification process.
    4. If consignee is not able to take delivery of shipment in 2 attempts the same will be returned to the location from where the product has been dispatched (Mumbai). On return of the product to dp Gold Jewellery, dp Gold Jewellery shall be entitled for the additional charges incurred in respect of any further delivery of the consignment, and the same shall be reimbursed in advance.

    47. CANCELLATION:

  47. Any person placing the order is required to make the full payment at the time of placing the order or part payment at the time of placing the order and the balance payment needs to be made within 24 hours of placement of order. In case if you fail to make the payment within 24 hours, the order shall be treated as cancelled. Funds received at the time of placement of order in this case shall be refunded within 7-10 working days subject to a cancellation fee of 5%.
  48. Order once placed on dp Gold Jewellery cannot be cancelled. However, the order placed can be offset by a re-sale to dp Gold Jewellery at the price set for that particular day for that particular product before the shipment is dispatched. Any such transaction for an offset by resale can only take place after a written request received and approved by Big Bullion Bazaar.
  49. The initiation of cancelling the order can be done over telephone, or email and dp Gold Jewellery shall provide with a confirmation which shall be expressly agreed by you. In the event of a confirmed cancelled order, you expressly authorize dp Gold Jewellery to automatically approve a 5% cancellation fee which would be deducted from the paid amount and the difference in amount will be refunded. You also agree that any market gains on such cancellations shall belong solely to dp Gold Jewellery. However, dp Gold Jewellery shall be entitled to deduct/claim any loss due to change in the market price arising out of the cancellation made by you.
  50. dp Gold Jewellery, at its sole discretion, also reserves the rights to cancel any particular order. You will be duly informed about the inability to process the order and the necessary refunds will be processed without any cancellation charges.

    51. REFUND POLICY:

  51. Satisfaction of our customers is the highest goal of dp Gold Jewellery. However there may be certain situations that may result in customers not being satisfied with our products and services and seek for a refund. The following are the scenarios in which you are entitled to claim refund from dp Gold Jewellery:-
    1. Product lost in transit
    2. Incorrect items shipped
    3. Product of an inferior quality is supplied than what was ordered with dp Gold Jewellery.
  52. In the unlikely event that an order gets lost during transit, by Big Bullion Bazaar shall wait for 15 days to track your lost order and if we are still unsuccessful to deliver the product then by dp Gold Jewellery will process the refund without any cancellation charges.
  53. No refunds will be given in the following cases:
    1. If anyone provides an incorrect or outdated delivery address.
    2. Two failed delivery attempts by our partners in reaching you to deliver the products.
    3. Package refused by the recipient without providing appropriate reason.
  54. Any refund will be processed by means of an online bank transfer to the bank account within the 15 days. Refund will go back to originating payment mode. For example, if payment is made with credit card, refund will go back to that same credit card.
  55. In case if anyone requires the amount to be transferred through a different mode or through difference a separate request in this regard is required in writing. dp Gold Jewellery reserves the rights to reject such request of different mode of refund.

    56. SHIPPING POLICY

  56. All products sold by dp Gold Jewellery can be considered for dispatch only after receiving full payment(s) against that order. The delivery period committed by dp Gold Jewellery is tentative, provided based on primary locations and major cities. Deliveries to suburban areas and interiors of locations may take additional time.
  57. The Packaging as well as wrapping of the product(s) sold by Big Bullion Bazaar is as per specified guidelines to ensure the product(s) reach you in the best possible quality. However, we may not be able to ensure the handling and damage caused in transit, if any, by courier companies before reaching you. We advise you, therefore, to not accept any damaged or tampered shipments as it will not be possible to provide any support in case any products are missing. In the event, such damages or tampered shipments are accepted and not reported, dp Gold Jewellery shall not be liable for any loss of any product or its quality.
  58. In case if the package is found to be tampered, dp Gold Jewellery advises you to prepare a video of unboxing the product(s) for security purposes.
  59. Please note that dp Gold Jewellery will not be responsible for any reimbursements or insurance claims on packages that are successfully delivered as addressed. Our liability and insurance cease the moment the package is signed for or left at the specified delivery address. Any issues or problems with a shipment must be reported to dp Gold Jewellery within two business days. dp Gold Jewellery shall exercise discretion in accepting such request beyond two business days.
  60. In case the package is lost or damaged in transit, dp Gold Jewellery assumes responsibility to pursue any claim with the insurance company, provided, you agree to cooperate with dp Gold Jewellery in filing a claim for damaged/lost merchandise in any manner.
  61. dp Gold Jewellery shall file a claim if the product is lost or damaged. The ownership of the product(s) remains with dp Gold Jewellery and the amount paid to dp Gold Jewellery shall be refunded at the discretion of dp Gold Jewellery.
  62. dp Gold Jewellery works with Registered & Renowned Courier Partners. The delivery of the product will be handed-over to the authorized person after Verification process sent on registered number.
  63. The product(s) are shipped and insured till it safely reaches you. However, we request you to always verify the shipment before accepting and if found to be tampered or damaged; it shall be immediately informed to Big Bullion Bazaar.
  64. dp Gold Jewellery shall not be responsible in the event of default or any wrongful, dishonest, criminal, fraudulent act or wilful misconduct or gross negligence on the part of these intermediaries. However, Big Bullion Bazaar requests you to immediately inform dp Gold Jewellery on occurrence of such an event through e-mails/telephone or any other convenient means. The activities of the Intermediaries and its personnel/ representative(s) shall not be construed to be activities of Big Bullion Bazaar. dp Gold Jewellery undertakes to initiate appropriate action as it deems fit or inform the concerned authorities, if so required and act on a complaint.
  65. Courier partners might also request for undertaking the verification process until the delivery is complete. The said verification process is not restricted to submission of One Time Password (OTP) by the customer in whose favour the consignment is issued. OTP shall be sent only to the mobile number of the customer, which is registered with Big Bullion Bazaar in this regard. Only upon submission of the OTP, as issued by Big Bullion Bazaar, the delivery is deemed to be complete.
  66. Submission of any wrong OTP shall result in the failure of the verification process by the customer. However, dp Gold Jewellery reserves the right to resend OTP not more than three times to the same customer, on continuous failure to provide the correct OTP.
  67. Over and above three attempts, the customer has to contact Big Bullion Bazaar and only on specific request by the customer in writing and further completion of verification process as determined by dp Gold Jewellery, the customer shall be handed over the consignment. dp Gold Jewellery shall have the right to request for personal appearance of the customer at the office of dp Gold Jewellery on a specified date and time. Further, Big Bullion Bazaar shall request for a copy of the attested Identify Card of the customer for its record and shall also verify the same with the Original Identity Card or any other document of the customer. Only upon completion of this process, the customer shall be handed over the consignment.
  68. dp Gold Jewellery further has the right to forfeit the delivery of the consignment on unsuccessful attempt of the customer in the verification process.
  69. Further, dp Gold Jewellery shall also change the mode of verification process, as per the change in law, technology or due to any other circumstances.

    70. DELIVERY SPECIFICATIONS

  70. Orders can be delivered to location expressly mentioned. The delivery of the orders cannot be made to any public places including Malls, Hotels, Restaurants, Hostels or nearby streets.
  71. In case of change of delivery location, dp Gold Jewellery will not be responsible for products delivered anywhere outside the specified delivery address.

    72. CERTI CARD

  72. Apart from the above-mentioned Silver Certificate, dp Gold Jewellery shall provide a Certi Card. Certi Card is a Certificate of Authenticity, which shall be present inside the temper proof packing along with the physical product, certifying the authenticity of the quality and the packing of the product, and all terms provided therein shall be subject to the terms and conditions provided herein.

    73. RECIPIENT IDENTIFICATION:

  73. The complete details of the recipient (as it is stated in their photo identification that is approved by the Government) shall be provided for hassle-free delivery. Driver’s License or Aadhar Card is accepted for this purpose.
  74. Any request that involves handing over the product to any other person other than the purchaser himself, an email confirmation from the registered email address, along with the authorization of the purchaser and photo identity proof is required to be submitted with Big Bullion Bazaar to ensure smooth completion of delivery.

    75. ASSIGNMENT:

  75. dp Gold Jewellery shall be permitted to assign, transfer, and subcontract all or any its rights and/or obligations under these terms & conditions under the law.

    76. PRIVACY

  76. dp Gold Jewellery is strongly committed to your right to privacy and to keeping your information secure. The information/data collected shall be used to process the order and to provide the best possible service. The personal information/data received by dp Gold Jewellery may also be used in keeping you updated about the launch of any product or any other information about any of the existing products, related products/services by other vendors, social media suggestions, offer in general or specific as applicable.
  77. dp Gold Jewellery will never collect sensitive and financial information about you without your explicit consent. The information we hold will be accurate and up to date. Any query regarding the information present can be verified by email from the registered user. If you find any inaccuracies we will delete or correct it promptly. The personal information which we hold will be held securely in accordance with our internal security policy and the law.
  78. We shall send you promotional emails about the new products, special offers, to conduct market research, get a better understanding of what you need and other information we think you may find suitable on your registered email address. We shall also give you a chance to refuse any marketing email from us.
  79. All the information provided to us by you, including sensitive personal information, is voluntary. You have the right to withdraw your consent at any time, in accordance with the terms of this User Agreement, but please note that withdrawal of consent will not be retroactive.
  80. You can access, modify, correct and eliminate the data about you which has been collected pursuant to your decision to become a user of the Website. If you update any information relating to you, we may keep a copy of the information which you originally provided to us in its archives.
  81.     90. DISPUTES

  90. Any dispute or claim relating in any way between you and Big Bullion Bazaar shall be resolved by arbitration. The Terms and Conditions of Use shall be governed and interpreted in accordance to the laws of India and the courts at Mumbai shall have exclusive jurisdiction in all matters arising out of this Terms and Conditions of Use. The arbitration will be conducted in Mumbai by an independent arbitrator appointed by Big Bullion Bazaar.

    91. FORCE MAJEURE

  91. A force majeure event means any event beyond the control of Big Bullion Bazaar and includes events such as but not limited to floods, earthquakes or terrorist attacks etc. You acknowledge and understand that if Big Bullion Bazaar is unable to provide the products and/or services as a result of force majeure events, dp Gold Jewellery will not be in breach of any of its obligations to you under this Terms and Conditions of Use. Big Bullion Bazaar shall not have any liability to anyone whether in contract, warranty, tort, or any other form of liability for failing to perform its obligations under this agreement to the extent such failure is a result of a force majeure event.

    In case of inability of dp Gold Jewellery to make deliveries of coins, bars and jewellery bullion due to reasons beyond its control, dp Gold Jewellery may require that the deliveries be effectuated through specific modes of transport, including through local agents / jewellers. In such a case, you agree to bear any additional costs and fees necessary for the delivery to be complete after necessary information is provided.

    92. TERMS AND CONDITIONS OF THE SILVER CERTIFICATE

    1. The terms and conditions provided hereunder are subject to the terms and conditions as provided in www.dpgoldjewellery.com, terms of the Custodianship Agreement and shall be deemed to form part of the same.
    2. The Silver Certificate attached herewith is the Receipt of Vaulting provided by dp Gold Jewellery. This shall be in favour of the person as present in the invoice provided by dp Gold Jewellery.
    3. This Silver Certificate is not a negotiable or trading document.
    4. This Silver Certificate shall be emailed to you. You are further requested to keep a print out of the said certificate under your safe custody.
    5. In case of delivery by picking up from the vault i.e. Window delivery, you are required to
      1. Contact the dp Gold Jewellery’s Customer Care at 9930708333 or email to us at info@dpgoldjewellery.com along with a copy of ID proof, invoice details and copy of this Silver Certificate. Big Bullion Bazaar shall inform you on the reference number of the product and the pick-up details.
      2. You shall sign and submit the print out of this Silver Certificate at the Vault.
      3. You shall clear the remaining charges before taking delivery of the product. The customer care of dp Gold Jewellery shall provide assistance to you in this regard.
    6. In case of door step delivery of the product, you are required to
      1. Contact customer care at 9930708333 or email to us at info@dpgoldjewellery.com with invoice details, quantity and delivery address. The delivery shall be initiated upon payment of due delivery charges.
      2. It is informed that delay in doorstep deliveries, the same shall be dealt with as provided in the terms and conditions at www.dpgoldjewellery.com
    7. The Silver Certificate for the delivery taken will cease to exist on receipt of the delivery of the product, and shall not be utilised for any purpose whatsoever.
    8. In case partial quantity of the product is picked up, a new Silver Certificate will get generated and emailed by dp Gold Jewellery.

  93. USER CUSTODIAN AGREEMENT

    1. dp Gold Jewellery is engaged in the business of Bullion Trading under the name “dp Gold Jewellery” (hereinafter referred as “dp Gold Jewellery”). This Agreement provides for dp Gold Jewellery to act as your agent in the storing the tangible silver.
    2. The following agreement are the terms of a click wrap contract between dp Gold Jewellery and the user (referred to as “you”, “your” etc.), wherein the clauses of this agreement are accepted by you upon clicking the check box next the words “I agree to the agreement”. dp Gold Jewellery provides features to you, only subject to the acceptance of the following Agreement.

      3. IT IS HEREBY AGREED BY THE USER FOR THE CUSTODY OF SILVER WITH dp Gold Jewellery AS FOLLOWS

    3. dp Gold Jewellery reserves the right to alter, change, modify, add or remove portions in whole or in part of the clauses of this any time. Such changes shall be effective when posted on the Platform. Notwithstanding anything to the contrary, Customer shall be responsible for regularly reviewing the Terms, clauses including amendments thereto as may be posted on the Platform and shall be deemed to have accepted the amended Terms by continuing the use of Platform.

      4. DEFINITIONS

    4. In these Terms, references to:
      1. “Platform” means the website(s), apps, tools, platforms and/or other devices of dp Gold Jewellery and its affiliated companies through which the Service (defined hereinafter) is (made) available.
      2. “Product” shall mean tangible silver including coins, bars, bullions of different denominations.
      3. “Services” shall include but not be limited to facilitating purchase, keeping custody on behalf of the user, sale and transfer of Physical/Tangible Silver, purchase and cancellation of Tangible Silver, open sale & residual sale back to dp Gold Jewellery delivery services, customer care services and ancillary services thereto provided to the Customers through Platform(s),

      5. ELIGIBILITY

    5. Our Services are restricted to Customers who are 18 years of age or older. We do not permit Customers under the age of 18 on our platform and we do not knowingly collect personal information from anyone under the age of 18. Accessibility is limited only to those who are not prohibited from entering into a contract of service of this kind by laws applicable in their competent jurisdiction. With this understanding, you specifically agree that by using the Platforms, You are at least 18 years of age and you are competent under law to enter into a legally binding and enforceable contract.

      6. STORAGE

    6. By placing order with dp Gold Jewellery, you agree for the storage arrangement where dp Gold Jewellery will store/ keep custody on of the product, on your behalf under dp Gold Jewellery’s storage agreement with third party secured vaulting service providers.
    7. You further agree to bear the vaulting charges accrued till physical delivery of the product is completed. You also agree to settle the charges with dp Gold Jewellery before taking physical delivery of the product. In the event of there being any default in paying such charges for a period of over 30 days, dp Gold Jewellery shall be at liberty to sell the product on the prevailing market rate on 30th day of default, and will reimburse such sale proceeds after deducting vaulting charges due.
    8. dp Gold Jewellery assures that the products stored with vaulting agents are safe, secured and insured. The products mentioned in the Silver Certificate (Receipt of Vaulting) are under the possession of dp Gold Jewellery and the ownership rights lie with you. In the event there is any change in the vault location and/or service provider, the same shall be notified to you by email.

      9. INSURANCE COVERAGE

    9. The custody of the product shall come along with an insurance. Such insurance shall broadly cover, damage, theft, fire or occurrence of any natural calamity.

    11. Silver Certificate / Silver in Vault:
      1. A Silver Certificate shall be issued to you through email. You may take a print out of the same for your records.
      2. You shall pay the vaulting and insurance charges 15 days advance.
      3. You can either opt for “pick up from vault” or “doorstep delivery” by sending a request from the registered email ID. These facilities can be opted at any time.
      4. Before choosing “pick up from vault” or “doorstep delivery”, you will have to clear the vaulting and insurance dues.
      5. For “doorstep delivery”, logistic cost will be charged.
    12. Pick up from the Vault:
      1. You can pick up the product from the vault directly and vaulting window service charges that are collected at the Vault, needs to be cleared before collecting the products.
      2. Delivery shall be given only if proper ID proof and invoices are presented at the vault. Further, ID Proof of the person collecting the goods needs to be emailed to by dp Gold Jewellery. dp Gold Jewellery’s customer care team will inform you the details of the pickup.
    13. Door step delivery (delivery to self or someone else):
      1. Delivery will be done to shipping address which is provided to us.
      2. Normal delivery charges of logistic & insurance have to be paid by you. In case if any person other than the direct beneficiary is taking the delivery of the product, the ID proof of the person who will be accepting the product along with an authorisation letter from you needs to be emailed to us as a security measure.
      3. ID Proof of the person receiving the goods and authorisation letter needs to be presented and verified at the time of delivery. The product shall be handed over only after the completion of verification process.
      4. If consignee is not able to take delivery of shipment in 2 attempts the same will be returned to the location from where the product has been dispatched (Mumbai).

      14. ASSIGNMENT:

    14. dp Gold Jewellery shall be permitted to assign, transfer, and subcontract all or any its rights and/or obligations under these terms & conditions under the law.

The arbitration will be conducted in Mumbai by a sole arbitrator mutually appointed by both parties.
